Marriage has become highly controversial in America, most
recently because of the claim of a civil right to same-sex
marriage. The popularity of this cause is fueled by the
idea that the moral and natural institution of the family
is somehow at odds with freedom. In fact, however, family
and freedom are essentially connected.

The Declaration of Independence says that "all men are
created equal" and "endowed by their Creator with certain
unalienable rights." This establishes the idea of rights
not only for Americans, but for all people. Above that
famous passage, in the first sentence of the Declaration,
it mentions the "laws of nature and of nature's God." It
is in this conception of nature that freedom and family
come together.

Human beings possess rights because of their nature, and in
particular because that nature includes reason. They are
moral agents in ways that other creatures, who are governed
by instinct, are not. Thomas Jefferson wrote that "some men
are not born with saddles on their backs, nor others booted
and spurred to ride them by the grace of God." The natural
freedom of man comes from the part of his nature that
enables him to choose.

Human beings also form families because of their nature.
This stems from the fact that for many years -- much longer
than for other animals -- human children must be cared for
by others. This care is difficult and requires great
sacrifice. And the way it is accomplished is all-important,
because the difference between well-raised and poorly-
raised people is much greater than the difference between
well-raised and poorly-raised horses or cows. Common sense,
and more recently social science data, indicates that this
difficult long-term job can best be, and should be,
accomplished by parents.

The Founders were strong believers in the importance of
family, and in laws that support the family, because the
family is the natural way that human beings are born and
raised, and also because it is essential to freedom.
Through the natural family one gets the best citizens, and
for a nation to be free, it needs good citizens.

This is a simple explanation of the deep reasons why
marriage, family, free government, and individual liberty
have always been thought connected.

we have just published in connection with the upcoming vote
on Proposition 22, which would amend California's Family
Code to read that "Only marriage between a man and a woman
shall be valid or recognized." The first is "A Citizen's

Brian Kennedy. The second is "Will Any Two Parents Do? The
Essential Role of Mothers and Fathers in the Raising of
Children," by the Director of our Program for the American
Family, Eloise Anderson, and Institute Director of
Publications Ben Boychuk.
